Terms of Service

Welcome to Aster Kamino Finance ("Platform", "we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of our website, decentralized applications, smart contracts, and related services during our Beta testing phase.

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Platform.

1. Acceptance of Terms

By connecting your cryptographic wallet, interacting with our smart contracts, or otherwise using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety.

2. Eligibility

You must be at least 18 years of age to use the Platform. You represent and warrant that you have the legal capacity to enter into these Terms. You may not use the Platform if you are located in, or a citizen or resident of, any jurisdiction where the use of the Platform would be illegal or subject to regulatory prohibition.

3. Beta Service / Testing Disclaimer (CRITICAL)

The Platform is currently in a Beta testing phase (Testnet). This means:

The software is experimental and provided "AS IS" and "AS AVAILABLE" without any warranties.
DO NOT deposit or interact with real funds or mainnet assets. Only use testnet tokens (e.g., Goerli/Sepolia ETH) provided via faucets.
You acknowledge and accept that the Platform may contain bugs, errors, and defects that could result in total loss of (testnet) funds or data.
We reserve the right to reset, rollback, or modify the testnet state, smart contracts, and user balances at any time without notice.

4. User Accounts and Wallets

Aster Kamino Finance is a non-custodial platform. We do not host your wallet or hold your private keys. You are solely responsible for maintaining the security of your wallet and private keys. We cannot assist you with password retrieval or wallet recovery.

5. Acceptable Use

You agree not to engage in any of the following prohibited activities:

Using the Platform for any illegal purpose or in violation of any local, state, national, or international law.
Attempting to exploit, hack, or otherwise interfere with the security or integrity of the Platform's smart contracts (except through authorized bug bounty programs, if applicable).
Using the Platform to facilitate money laundering, terrorist financing, or other illicit financial activity.
Impersonating another user or entity.

6. Intellectual Property

Unless otherwise indicated, the Platform, including its code, designs, logos, and written content, are the property of Aster Kamino Finance and its operators. During the Beta phase, the smart contract source code may remain closed-source pending final audits.

7. Risk Disclosure

Interacting with decentralized finance (DeFi) protocols involves significant risks, including but not limited to:

Smart Contract Risk: Vulnerabilities or bugs in the code.
Volatility Risk: Cryptographic assets are highly volatile.
Regulatory Risk: Changes in laws or regulations may impact the legality or functionality of the Platform.
Network Risk: Issues with the underlying blockchain networks (e.g., Ethereum, Arbitrum).

8. No Financial Advice

Nothing on the Platform constitutes financial, legal, tax, or investment advice. The Platform is an infrastructure tool for executing user-directed transactions. You are solely responsible for your trading decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ASTER KAMINO FINANCE, ITS OPERATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM.

10. Indemnification

You agree to defend, indemnify, and hold harmless the Platform and its operators from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

11. Termination

We may terminate or suspend your access to the Platform (including revoking testnet access) immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

13. Dispute Resolution

Any dispute arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in Portugal, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
